Lucius Marshall Butler - Last
Will and Testament
I, Lucius M. Butler, of Cranston,
in the State of Rhode Island, being of sound mind and body do declare this to be
my last will and testament. And I also declare that no person whatever is
aware of the disposition I am about to make of my property.
I direct that all my just debts,
including the expenses of my last illness and burial be first paid out of my
estate.
I give, devise and bequeath to my
son, Henry Earl Butler, the sum of Five Dollars and no more under any
circumstances. I make this provision as he has convinced me by his conduct
that he is not a fit person to be in control of any money.
After the payment of the above, I
give, devise and bequeath absolutely and entirely to my wife, Elvira A. Butler,
all cash monies belonging to me that may be on deposit or otherwise found at the
date of my decease. All the rest and residue of my estate, real, personal,
and mixed and wherever situate of which I may die seized and possessed or
entitled to, I give, devise and bequeath to my said wife Elvira A. Butler for
the term of her natural life, to be divided at her decease in equal shares
between my three children, Herbert Marshall Butler, Lucian Abbott Butler and
Helen May Butler Spahn, or to the survivor or survivors of them if either should
be not living at the decease of my said wife and shall have left no issue then
surviving, if either of my three children last named shall be not living at the
date of the decease of my said wife but shall leave issues, said issues shall
take the parents' share.
I nominate and appoint my wife, Elvira A. Butler,
Executrix of this my last will and testament and request that she be not
required to file an inventory of my estate or give bond as such executrix.
